1. Subject and scope of application

These General Terms and Conditions of Sale (GTCS) govern the sale of gourmet picnic baskets and any related services offered by Cappuccetto Verde, a sole proprietorship. By placing an order, the customer declares that they have read, understood, and fully accepted these GTCS.

2. Products

The descriptions and images on the site are purely indicative. Each basket is created based on seasonal availability and the chef’s creativity: the exact content is a pleasant surprise for the customer.

3. Allergens and dietary restrictions

Products are prepared in a kitchen that handles the 14 allergens regulated by EU Reg. No. 1169/2011, including cereals containing gluten, crustaceans, eggs, fish, peanuts, soy, milk, nuts, celery, mustard, sesame, sulfur dioxide and sulfites, lupins, and mollusks. The absence of cross-contamination cannot be guaranteed.

It is the customer’s responsibility to communicate any food allergies or intolerances at the time of booking. Customers with severe allergies are advised to consider carefully before ordering.

4. Ordering process

• Orders can be placed through the website or via partner collection points.
• After order confirmation, the customer receives a summary email with the booking details.
• The deadline for ordering is 5:00 PM the day before the event.

5. Payment

Payment is currently accepted in cash at the time of collection or delivery. Payment methods may be expanded in the future; any changes will be communicated on the website.

A cash deposit of €100.00 is required for each basket to guarantee the return of the basket and accessories in good condition. The deposit is refunded upon the return of the material intact.

6. Operating area

Cappuccetto Verde baskets are available in the Langhe, Roero, and Monferrato areas (provinces of Asti and Cuneo, Piedmont).

7. Collection and delivery

The customer can collect the basket at one of the affiliated partner points (wineries, farmhouses, accommodation facilities). It is possible to request delivery to another location or directly to the chosen picnic spot, subject to agreement and confirmation in the booking email.

Delivery is free only at the partner points indicated on the website. For deliveries to other locations in the area, the additional cost will be communicated in the booking email.

The customer is expected to be available at the agreed time. Unjustified absence does not entitle the customer to a refund.

8. Period of activity

Cappuccetto Verde operates approximately from April to the end of October. The precise seasonal opening and closing dates are communicated on the website and social media channels. Bookings outside this period are evaluated on a case-by-case basis.

9. Use of baskets

Baskets and accessories (cutlery, dishes, blankets, etc.) are provided on loan for the duration of the picnic and must be returned in the same condition in which they were delivered. Damage, loss, or failure to return will result in the total or partial withholding of the deposit, without prejudice to the right to compensation for greater damage.

Baskets are intended exclusively for the customer’s personal use. Any commercial use or resale is prohibited.

10. Special events

Cappuccetto Verde organizes two types of gourmet picnic-themed events:

a) Public events

Cappuccetto Verde may organize events open to the public (e.g., collective picnics, initiatives in collaboration with local partners). Participation methods, prices, and registration conditions are communicated from time to time on the website and social media channels. The applicable cancellation conditions are those set out in Article 11.

b) Private events

It is possible to book a personalized private event (e.g., bachelorette/bachelor parties, birthdays, anniversaries, team building, etc.). The following specific conditions apply to private events:

• Number of participants: up to 10 days before the event, the customer communicates an approximate number of participants. Confirmation of the exact number must be received at least 72 hours before the event. After this deadline, the number cannot be reduced and billing will be based on the confirmed number.
• Changes: after confirmation of the exact number (72 hours before), no reductions in participants are accepted. Any additions are evaluated on a case-by-case basis based on availability, subject to written confirmation.
• Cancellation: private events can be canceled without penalty up to 72 hours before the agreed date. Cancellations made within 72 hours prior to the event do not entitle the customer to a refund. In case of timely cancellation, any deposits already paid will be refunded within 7 working days, minus any expenses already incurred and documented.
• Deposit: a deposit may be required for private events at the time of confirmation. The amount and methods will be indicated in the quote.
• Force majeure: in case of unpredictable events that make it impossible to hold the event, Cappuccetto Verde will propose an alternative date or a full refund.
• In case of adverse weather conditions (persistent rain, weather alerts, or conditions incompatible with an outdoor picnic), Cappuccetto Verde will take steps to ensure the event continues in the indoor spaces of the host facility, where available, or will propose a postponement to an alternative date agreed with the customer.

11. Cancellation and refunds – standard orders

For individual basket orders, cancellation is possible without penalty until 5:00 PM on the day before the booked date. Cancellations made after this deadline do not entitle the customer to a refund, except for proven force majeure cases evaluated on a case-by-case basis.

In case of adverse weather conditions (persistent rain, weather alerts, or conditions incompatible with an outdoor picnic), the customer can choose from the following options: consume the basket in the indoor spaces of the partner facility, if available; postpone the booking to an agreed date; or cancel the order without penalty, provided the request is received by 5:00 PM the previous day.

No refund is provided for cancellations communicated on the day of the event.

12. Liability

Cappuccetto Verde is committed to ensuring the quality and freshness of products at the time of delivery. Any complaints must be communicated within 24 hours of receiving the basket to info@cappuccettoverde.com.

Cappuccetto Verde’s liability is limited to the value of the order and does not extend to indirect or consequential damages.

Product storage

Baskets contain fresh and perishable products. After delivery or collection, the responsibility for proper storage passes to the Customer.

Cappuccetto Verde is not responsible for deterioration or problems resulting from inadequate storage (e.g., exposure to the sun, high temperatures, lack of refrigeration).

It is recommended to keep the basket cool and consume the products within 2-4 hours.

13. Intellectual property

All website content (texts, photos, logos, graphics) is the exclusive property of Cappuccetto Verde or its licensors and is protected by Italian and European copyright laws. Any unauthorized reproduction or use is prohibited.

14. Applicable law and jurisdiction

These GTCS are governed by Italian law. For any dispute arising from the interpretation or execution of these GTCS, the parties undertake to seek an amicable solution first. Failing agreement, the Court of Asti shall have exclusive jurisdiction.
